e students will be able to 1) know relevant construals and methods inscribed within the perspective of narrative medicine and other approaches, which place the patients and their agency at the center of doctor-patient communication and of all health processes (I Desciptor: Knowledge and Understanding);); 2) ;to know and apply methods and tools of qualitative research ( ethnographic observation, conversation and narrative analysis) to comprehend forms, in which experiences and narratives of illness by people who suffer it, in different contexts, and apply those methods to the design of participant structure within different health contexts (II Descriptor: Applying knowledge and understanding); 3) to develop critical judgment and decision making skills by means of exercises in which it is necessary to assess and critically reinterpret what has been studied and to use in reflexive and responsible ways the methodologies that have been learnt (III Descriptor: Making judgments; 4) to develop skills in the presentation and discussion by means of small group collaborative activities and the writing of scientific reports (IV Descriptor: Communication skills); 5) to develop skills in the continuation of autonomous learning of theoretical, methodological and applied knowledge, and in the integration between literature , methods and group practices experienced in the classroom (V Descriptor: Lifelong learning skills)

The course aims to illustrate the main topics of administrative law with a distinctly practical slant and aims to provide the essential notions of the subject and the fundamental skills to consciously elaborate on the institutions of public action. The course essentially deals with issues related to administrative action and in particular the administrative measure and its pathology, with particular reference to the health sector. Particular attention is paid to the administrative institutes recurring in the professional experience of healthcare personnel. At the end of the course, students will have acquired a comprehensive knowledge of the issues and institutes of Italian administrative law as far as they are useful to the profession, as well as the ability to understand and evaluate, also critically, the relevant regulatory sources.

The course privileges an ethnometodological, cultural and discoursivist perspective to the study of social interactions in the organizational context, which recognizes to all social agents, including those who appear as most vulnerable such as psychiatric patients, oncological patients or migrant patients, competences and interpretive abilities , which are necessary for mutual comprehension. Within this perspective, a central attention have the concept of cultural mediation, artefacts, language, members’ categories, istitutional identities.
By means of ethnographic methodology in health organizations, the analysis of social interactions and the analysis of cultural artefacts (e.g. writing practices, clinical records) used in various institutions, the course aims to show and discuss the complexity of social actions and organizational cultures in rehabilitation contexts.

Learning Unit 1 - The sources of administrative law (1 hour).
The principles of administrative law in the Constitution (good performance and impartiality). Law No 241 of 7 August 1990. The other sources: sectoral norms and Community norms.

Learning unit 2 - Legal situations in administrative law (1 hour).
Subjective rights and legitimate interests. The exercise of administrative power. The principle of legality (in the weak, weak, strong sense). Binding acts and discretion. Administrative discretion and technical discretion.

Learning unit 3 - The principles of administrative law and administrative action (1 hour).
Economy, effectiveness, impartiality. Proportionality. Reasonableness. Publicity and transparency. Simplification and celerity. Smart administration: the 'result' principle (from administration by acts to administration by results). Digitalisation. Hints at the role of private law and related institutions (administrative activity under private law) The principles of Community derivation (legitimate expectations, legal certainty, precaution).



Learning Unit 4 - The administrative procedure (1.5 hours).
The administrative procedure and its principles: the stages (initiation, preliminary investigation, decision-making, supplementary effectiveness). The communication of the initiation of proceedings. The RUP. The preliminary, administrative and technical investigation. The time limits for concluding the procedure. The procedural adversarial process (establishment, procedural participation, participatory contributions and institutions, participation of legal persons). Loyal collaboration. Substance and form in the administrative procedure. Simplification and institutes of procedural concentration (services conference, silence-consent between administrations, non-binding opinions). From the procedure to the measure: principle of motivation and communication of the grounds for refusal. The rejection notice.

Learning Unit 5 - The administrative measure (1.5 hours).
Documents, acts, measures. Types of measures (ablatory, sanctioning, authorising, sanctioning measures). The pathology of the administrative measure. Inexistence. Nullity. Annulability (incompetence, excess of power, violation of the law). Second level measures: withdrawal, annulment in self-defence, revocation. Agreements replacing the measure.

Learning Unit 6 - Hints at relevant institutions. Access to documents (Law 241/90, civic access, FOIA) (1 hour).
The principles of administrative documentation and certification and self-certification. Public contracts (competition, par condicio, public evidence, tendering principle and its exceptions).

Learning Unit 7 - Outlines of administrative organisation (1 hour).
The principles of administrative organisation in general. Decentralisation, autonomy, subsidiarity, adequacy, differentiation, unity of the function, inter-institutional collaboration, "principle of understanding", continuity of the function. The organisation of offices (in particular Art. 97, para. 2 Const.).



Learning Unit 8 - Administrative law in health matters (1.5 hours).
Public health from an administrative perspective. Hints at the evolution of the bodies of the health system: from the USL to the Aziende Sanitarie. Corporatisation. SSN: historical outlines and regionalisation. The SSN today: organs, functions, competencies. Health federalism. Healthcare companies today. The provision of services (in particular PSN, PSR and corporate plan coordination). Organisation. Health and the private sector (in particular accreditation and contracting). Health in the Constitution and the administrative organisation to make the right effective. Health governance and LEAs. Purchasing. Public procurement (planning of purchases, types and execution of public contracts, public-private partnership). In particular: elements of administrative law for the psychiatric professional and psychiatric rehabilitation technology.

Learning Unit 9 - Workshop (0.5 hrs).
Relevant case law on administrative law with particular reference to health care and psychiatric rehabilitation. Relevant and recurrent administrative law with special reference to health care and psychiatric rehabilitation. Some practical examples: access to records, the compulsory health treatment measure.

The course adopts a varied range of methods, including lectures, analysis and discussion of videorecording and transcription of interactions and organizational practices in group, practices of data analysis and interviews, observations and practices of transcription of interactions, experts’ presentation of research and interventions, regarding the design of socialization practices in educational contexts.

Instructors will create a Moodle page, in order for the students to share texts, material and videos, useful to deepen the topics discussed in the classroom, to promote the sharing of ideas and material among regularly attending students, and to help students perform homework during the course.
