Comparative and European Public Law
Course objectives
Knowledge of the general frame of the historical evolution of western constitutionalism, as well as on its relation with constitutional experiences. Knowledge of the dynamics typical of multilevel constitutionalism. Knowledge of the constitutional and legal dimensions of human dignity, as well as of the relation between constitutional comparison, relation among legal orders, and protection of fundamental rights. Ability to discuss cases, orally or in writing.

Course program
The course will be divided into three parts.
The first part of the course will address the objectives and methods of legal and constitutional comparison, including a historical-conceptual reconstruction and an overview of the main contemporary methodological options. The second part of the course will provide a historical profile of modern and contemporary constitutionalism (English tradition, North American tradition and French tradition). Finally, the third part of the course will address the main forms of government, as matured in the experiences traceable to European and North American constitutionalism.

Full knowledge of basic elements of public and constitutional law - knowledge of English

A. Buratti, Western Constitutionalism. History, Institutions, Comparative Law, Giappichelli, 2023. Further papers and materials will be indicated throughout the course.

Oral exam, with possible written test for attending students.
