The first part of the course will be dedicated to the reconstruction and analysis of the fundamental principles of private law, specifically property, contracts, civil liability, and the analysis of sales contracts. In particular, the discipline of ownership and copyright protection of works of art will be addressed.
The second part of the course will focus on the private law aspects related to the circulation of works of art. It will analyze the sale of works of art in its various forms (private sale, through a dealer or art gallery, public auction, distance selling), the protection of buyers in the event of the purchase of fake works and false attributions, the liability of those certifying authenticity, both directly and indirectly (experts, foundations, catalogs, artist archives), the lending of works of art for exhibition purposes, and the private law implications of the regulations on the export of works of art. Particular attention will also be paid to the civil law and copyright aspects of street art.
