The aim of the course is to provide useful tools to understand how Information and Communication Technologies (ICT) – artificial intelligence in particular – can impact the context of the “digital administration” and, more generally, public action. The course aims to delve into the main issues of the law of new technologies applied to public administration and the so-called e-democracy and the main reference institutions. The course also delves into the orientations of jurisprudence and practice through the discussion of practical cases in the classroom.

In-depth knowledge of all issues relating to the law of new technologies applied to the context of public decisions.

Knowledge of the principles of public law

The program will be developed on three macro-topics:
1. P.A., art. 97 Cost., constitutional principles of transparency, information and citizen participation in the action of the public administration (law 241/90 and participatory tools, communication of initiation of proceedings, obligation to provide reasons, supplementary and substitute agreements for the proceedings, right of access, including civic access and simplification)
2. Digitalization (CAD), data and privacy (GDPR), right to be forgotten; open data, open access; Ai Act and automated decisions
3. Representation of interests: lobbying; e-democracy; democratic participation through new technologies, the use of artificial intelligence systems in legislative assemblies.

Teaching is delivered primarily through lectures,
which address the program's main topics. Teaching activities will also include
some in-class exercises designed to facilitate student development
individual study. Finally, seminars on specific course topics are planned.

Course attendance is optional.

Students who successfully complete an in-depth presentation on topics related to the course will be exempted from (i.e., will not be required to) take the oral exam for that part of the course covered by the in-depth presentation. Students who fail the exam, choose not to take it, or are dissatisfied with their grade will be exempted from the oral exam.
