Objectives

Knowledge and understanding: students will be able to understand the main institutes of private Italian law, understood as a set of rules concerning the relationships between private individuals, taking as a fundamental reference the civil code.
Applying knowledge and understanding: students will be able to apply the institutional notions, to interpret a legal text, to read and understand a judicial decision, to verify the legal consequences deriving from a certain conduct of private individuals.
Making judgement: students will develop a critical perspective of legal issues, problematically reflecting on the orientations of doctrine and jurisprudence.
Communication skills: students will develop the ability to display legal problems, through the conceptual categories and the technical language of the sector
Learning skills: students will develop the aptitude for legal reasoning and will acquire the functional bases for the study of the other subjects of the disciplinary field.

Programme

General concepts and introductory to the study of private law (sources of law, interpretation of the law, rule of law, subjective legal situations); discipline of persons and the family (Book I of the Civil Code). Discipline of successions and donations (Book II of the Civil Code). Discipline of assets, categories of assets. Properties. Real rights of enjoyment. Possession (Book III of the Civil Code). Discipline of bonds in general. Treatment of contracts in general, with nods to the theory of legal business. The individual contracts covered in Book IV of the Civil Code with the exception of bank contracts. Discipline of unilateral promises, debt securities (general survey), the management of the affairs of others, the payment of amounts, of unjust enrichment. Introduction to the discipline of checks. Discipline of the offense (Book IV of the Civil Code). Regulation of transcription. Law of evidence civilians. Discipline of prescription and decadence. Discipline of financial liability, causes of pre-emption and the warranty sheet. Discipline of the judicial protection of rights (Book VI of the Civil Code).

Is excluded from the study program of the debt securities (with the exception of general remarks above), enterprise, employment, company, copyright and competition, consortia and companies, contracts stock market and financial intermediation, bankruptcy procedures.
