Course objectives

The course of Institutions of Private Law is designed to enable students learning fundamental concepts of private law; the complex rules that govern relations between individuals and between individuals and Public Administration where the latter acts privatorum jure, or as private individual and without the exercise of its powers which are authoritative. The knowledge of the foundations of private law supposes several methodological choices, which will be devoted to the completion of the first part of the course to allow the acquisition of all the tools needed to interpret legal texts and understand the functioning of the legal syllogism . Which, according to the methodological path that is suggested, is divided into major premise, minor premise and conclusion. Particular attention will be given the right of contract law and contracts, which are key institutions in the formation of both the professional and managerial functions of those who, wishing to continue their studies, wish to acquire skills to undertake the auditors, accountants and business professionals. Central, therefore, the role of movement and legal instruments mortis causa and inter vivos that this system relies on the production and exchange of goods and services. Foreground: Students who have passed the examination will be able to apply the institutional knowledge to interpret a law to check what the legal consequences of a certain conduct of individuals, to distinguish the main rights over things. Will also be able to understand the main legal instruments movement, judged on individual circumstances of each case, what tools should be considered preferable in order to meet the needs that from time to time arise, identifying, so also features the choice of a differential rather than another instrument. Acquired skills: Students who have passed the examination will be able to make a basic legal advice on privatization issues, people's rights, family law, succession law, the right property, the law of obligations and contracts. Will also be able to conduct a technical institutional trading, and assesses the legal and economic implications, suggesting that the best solution. Will finally be able to write the text of the elementary exchange or associations to prepare the text of the main package of unilateral acts and an elementary holographic will, in accordance with the rules.

Prerequisites
Es necesario un buen conocimiento del italiano escrito y oral. En particular, un vocabulario rico y la capacidad de identificar la etimología de las palabras. Aunque no es estrictamente necesario, un conocimiento básico del latín es útil debido a la frecuente referencia a expresiones transmitidas por el derecho romano. Una predisposición elemental al uso de las herramientas de la lógica y la retórica es también ventajosa en la formulación de los conceptos y los modos de expresión típicos de la cultura jurídica.

Frequency
Se recomienda encarecidamente la asistencia a clase. En cualquier caso, sólo los alumnos que asisten a clase pueden optar a las evaluaciones intermedias y de exención. Para ser considerado asistente, es necesario haber participado en las actividades y haber asistido al menos al 80% de las actividades lectivas. La asistencia será registrada por el profesor, también por medio de la ficha.

Clases magistrales: El profesor hará cada día una presentación del tema previsto en el cronoprograma. Los estudiantes prepararán previamente las clases con la bibliografía básica recomendada. B. Seminarios: En función de las materias objeto de análisis en cada seminario, las actividades que se desarrollarán en los mismos pueden consistir, entre otras cosas, en: Casos prácticos. A partir de la formulación de unos hechos, el alumno ha de extraer los que sean relevantes e identificar las cuestiones jurídicas que originan. En algunas ocasiones, se plantearán al alumno una serie de cuestiones que le ayuden a orientar su análisis. Para la resolución del caso, el alumno ha de identificar las normas jurídicas, jurisprudencia o doctrina aplicables a los hechos planteados. Su labor consiste en extraer las conclusiones derivadas de la aplicación de estos materiales a los hechos del caso. La tarea del alumno no se limita a resolver cuestiones puntuales, sino que ha de dar una solución global e integrada al caso planteado. Por ello, es recomendable una reflexión sobre el conjunto de las cuestiones antes de proceder a la resolución del caso. En la clase presencial se procede a analizar el caso práctico, incidiendo en las cuestiones jurídicas detectadas por los alumnos, así como en las que propone el profesor. Lectura de material bibliográfico (lectura dirigida). En ocasiones, atendiendo a la especialidad de la materia, la clase práctica girará en torno a los materiales bibliográficos previamente suministrados por el profesor. En estos casos, la actividad presencial del alumno consiste, bien en la participación activa en el debate moderado por el profesor, en torno a las cuestiones principales que planten los materiales previamente analizados por el alumno, bien en un control de lectura, a través del cual tanto el alumno como el profesor puedan valorar el grado de comprensión real de la materia estudiada. En los debates, se valorará especialmente de qué manera defienden los alumnos una determinada posición o elaboran un argumento. Lectura y comentario de jurisprudencia. En este tipo de clases prácticas se propone al alumno el análisis de una o varias sentencias relevantes sobre un determinado tema. En esta ocasión, el alumno deberá realizar un comentario crítico del texto jurisprudencial, en el que tiene que identificar las principales cuestiones jurídicas que se plantean en la sentencia y comentar la solución dada por el órgano jurisdiccional. Para ello es imprescindible llevar a cabo una lectura detenida de la sentencia, a fin de poder identificar los hechos de la misma, las normas aplicables y la fundamentación jurídica en la que se apoya la resolución del órgano jurisdiccional. En el desarrollo de las clases se abordan las cuestiones jurídicas relevantes planteadas por los alumnos o el profesor y la doctrina contenida en la sentencia, tratando de someter ésta a un análisis crítico. Exposición de un tema o presentación de una ponencia en clase. Para la aplicación de los métodos anteriormente citados, el profesor designará, si lo estima oportuno, uno o varios ponentes.

Private law in general; its sources and means of study; in particular origins and events of the Civil Code. The facts and legal acts in general. Meaning and content of negotiating autonomy. Test and advertising. The legal relationship; the different fundamental legal situations. Natural persons: legal capacity, ability to act, tools for protecting the incapacitated; protection of personality. Legal entities; "Types" of legal entities; collective persons not personified. Real property and rights. Property in the Constitution, in the Code, in special laws, the real rights of enjoyment; communion; protection of possession. Real estate advertising. The compulsory relationship, patrimonial responsibility, guarantees. The contract in general with particular attention to the problems of conclusion, interpretation and invalidity. The main contracts named in the code and in the special laws. Non-contractual sources of obligation; business management, undue, unjustified enrichment. Fundamentals of debt securities. Liability for wrongdoing. The family, constitutional principles and current discipline. Succession due to death, with particular attention to the relationship between the family regime and the succession system. The liberalities among the living.
Prerequisites
First of all, a good knowledge of the written and oral Italian language is required. In particular, a rich lexicon and the ability to identify the etymology of words ensure the student a greater speed and security in understanding legal language. Although not strictly necessary, a basic knowledge of the Latin language is useful due to the frequent reference to expressions handed down by Roman law. Even an elementary predisposition to the use of the tools of logic and rhetoric has an advantage in the formulation of the concepts and in the expressive modalities typical of legal culture.

Should the need to comply with the preventive measures imposed by the Covid 19 emergency persist, the lessons will be held in the manner indicated by the academic authorities and can be mixed (with teacher in presence and students partly in presence and partly remotely) or only remotely with the use of the platforms made available by the University.
Exam mode
Ordinarily, the examination takes place in oral form. The student can ask to take the exam in two distinct sessions (so-called "exemption"). During the Covid 19 emergency phase, exams take place in writing through multiple choice questions on the Google Classroom platform.
