Course program
After an introduction to the phenomenon of globalization and its main dimensions (economic, political, and cultural), the focus will be on the ongoing transformations that are reshaping the geography of economic interdependence in an era of increasing geopolitical tensions. Through the use of the methodological tools of comparative law, the drives produced on the relationship between legal systems, particularly between civil law and common law systems, and on the circulation of models will also be highlighted.
It will then go on to analyze the process of approximation of contract law at the international level as a response to the need for simplification and certainty in today's commercial trade, focusing on the analysis of some particularly relevant normative instruments such as the 1980 United Nations Convention on the International Sale of Goods, the UNIDROIT Principles of International Commercial Contracts, and the INCOTERMS, also from the point of view of their mutual interaction. We will then focus on the phenomenon of global value chains as a way of organizing contemporary productive activity, with particular regard to contractual relations within the agri-food chain. Finally, we will reflect on the consequences of globalization on the labor market, with specific regard to the phenomena, of increasingly extensive proportions, of unlawful recruitment and exploitation of labor.
