Course program
The course is aimed at studying the main themes of comparative public law: methods, legal traditions, the history and spread of constitutionalism, forms of government, federalism, constitutional justice, and fundamental rights. In the first part of the course, the focus will be on the methodology of comparative law and a comparison will be made between common law and civil law systems (12 hours). Specific attention will then be dedicated to the study of forms of state and forms of government (20 hours). Subsequently, the course will address the historical process concerning the emergence of a constitutional status for fundamental rights, starting from the revolutions of the 17th and 18th centuries. To this end, the main turning points that marked the development of a constitutional framework for fundamental rights will be examined, as well as the main philosophical currents that supported their affirmation (natural law theory, contractarianism, positivism). Particular emphasis will be placed on fundamental rights within the constitutional state (25 hours). Regarding the topic of constitutional justice, the course will cover the different models of constitutional review from a historical and comparative perspective. Starting with the decentralized U.S. model, it will address the gradual emergence of constitutional review mechanisms in Europe, highlighting the differences among the German, Italian, and French systems. Finally, the current system of integrated protection of fundamental rights in Europe will be examined (21 hours). Lastly, the course will explore in more depth the themes of federalism and regionalism (9 hours). Specific exercises on selected topics covered in the course will also be conducted (9 hours).
Prerequisites
Knowledge of at least one foreign language is useful. There are no prerequisites.
