CHANNEL CHANGES (Criminal Procedure)

As a rule, students may request to transfer from Prof. Caprioli’s channel to other channels by filling out this form, having it signed by Prof. Caprioli and by the incoming professor, collecting attendance at lectures up to 75% of the total, and submitting the form to the Chair of the Degree Program for ratification.
The request must be based on convincing and well-grounded reasons (for example, work or other commitments that make it impossible or extremely difficult to attend the course at the scheduled times).
In the event that Prof. Caprioli does not authorize the transfer, the student may contact the Chair and present convincing and well-grounded reasons in order to obtain authorization for the channel change.

Students currently belonging to other channels, enrolled in the academic years 2021/2022 and earlier (both tutoring and regular course enrollees), and who belonged to Prof. Caprioli’s former channeling system or who had obtained a channel change towards Prof. Caprioli (“free,” or formally ratified), may continue to register for and take the exam with Prof. Caprioli without the need for further requests and without any expiry term.
Students currently belonging to other channels, enrolled in the academic years 2019/2020 and earlier (tutoring or regular course enrollees), and who did not belong to Prof. Caprioli’s former channeling system or who had not obtained any channel change towards Prof. Caprioli (neither “free” nor formally ratified), may take the exam with Prof. Caprioli only after following the usual procedure and attending the relevant course in order to complete the collection of signatures.
In any case, it is not permitted to take the exam with two different instructors during the same exam sessions.

LECTURE CALENDAR (Criminal Procedure)
The lectures of the Criminal Procedure course will be held, from September 18th to December 5th 2025, on the following days, times, and venues:

• Thursday, from 5 to 7:30 p.m. – Aula Falcone e Borsellino (ex 500)
• Friday, from 9 to 12 a.m. – Aula Falcone e Borsellino (ex 500)
• Friday, from 1 to 3 p.m. (seminars) – Aula Calasso

N.B. Due to classroom unavailability, on September 18th, 19th, 25th, and 26th, Thursday and Friday lectures will be held at the Faculty of Medicine – Aula A, General Pathology (PL 038).
The Friday seminar lectures are subject to rescheduling in case of unavailability of Aula Calasso. Any rescheduling will be promptly communicated.

EXAMS
The exams of the Academic Year 2024/2025 for the courses in Criminal Procedure, European Criminal Procedure, and Criminal Evidence Law, will be held, starting from 9:00 a.m., in the rooms indicated from time to time at the entrance, on the following dates:

Curriculum vitae

ITALIANO

Francesco Caprioli si è laureato in Giurisprudenza nel 1986 presso l’Università degli Studi di Torino, con voti 110 su 110 e lode. La sua tesi di laurea in procedura penale (La rimessione dei procedimenti penali, relatore il Chiar.mo Prof. Gilberto Lozzi) è stata ritenuta meritevole della dignità di stampa.
Nel marzo 1992 è stato nominato Ricercatore Universitario per il raggruppamento disci¬plinare n. 10 (in seguito Settore Scientifico Disciplinare IUS16). Fino 31 ottobre 1998 ha prestato servizio presso il Diparti¬mento di Scienze Giuridiche della Facoltà di Giurisprudenza dell’Università di Torino. Dal 1° novembre 1998 al 31 ottobre 2000 ha prestato servizio come Professore Associato di Diritto Processuale Penale presso la Facoltà di Giurisprudenza dell’Università degli Studi di Cagliari. Dal 1° novembre 2000 al 31 ottobre 2004 ha prestato servizio come Professore Straordi¬nario di Diritto Processuale Penale presso la medesima Facoltà. Dal 1° novembre 2004 al 30 settembre 2013 ha prestato servizio come Professore Ordinario di Diritto Processuale Penale presso la Facoltà di Giurisprudenza dell’Univer¬sità Alma Mater Studiorum di Bologna. Dal 1° ottobre 2013 al 20 dicembre 2022 ha prestato servizio come Professore Ordinario di Diritto Processuale Penale presso il Dipartimento di Giurisprudenza dell’Università degli Studi di Torino. Dal 21 dicembre 2022 presta servizio come Professore Ordinario di Diritto Processuale Penale presso il Dipartimento di Studi Giuridici ed Economici dell’Università di Roma Sapienza. È stato titolare degli insegnamenti di Diritto Processuale Penale (Università di Cagliari, Bologna e Torino), Diritto dell’esecuzione penale (Università di Cagliari, Bologna e Torino), Diritto delle prove penali (Università di Torino), Elementi di procedura penale e tossicologia forense (Università di Torino).
Dal 2014 al 2020 ha fatto parte del Collegio dei Docenti del Dottorato di Ricerca “Diritti e Istituzioni” presso il Dipartimento di Giurisprudenza dell’Università di Torino. Dal 2018 al 2019 ha fatto parte del Consiglio Direttivo della Scuola di Specializzazione per le Professioni Legali presso il Dipartimento di Giurisprudenza dell’Università di Torino. Dal gennaio 2024 fa parte del Collegio dei Docenti del Dottorato di Ricerca in Diritto Pubblico presso il Dipartimento di Studi Giuridici ed Economici dell’Università di Roma Sapienza.
Fa parte del Comitato di Direzione della rivista Cassazione Penale e del Comitato Scientifico della rivista Archivio della Nuova Procedura Penale. Ha fatto parte del Comitato Scientifico della rivista Diritto penale contemporaneo Rivista Trimestrale.
Dal febbraio 2011 al maggio 2013 è stato componente del Comitato Scientifico del Consiglio Superiore della Magistratura.
Dal 2008 al 2014 è stato componente del Consiglio Direttivo dell’Associazione tra gli studiosi del processo penale.
Dal 2023 è coordinatore nazionale del PRIN (Progetto di Rilevante Interesse Nazionale) dal titolo “PRIORITY. Shaping the Prosecution Organisational Model of Criminal Reports”, ammesso al finanziamento con decreto MUR n. 1409 del 23 settembre 2023.
Nel 2018 è stato tra i responsabili scientifici del progetto di ricerca internazionale “La giuria popolare di fronte alla prova tecnologica”, finanziato dal CUIA (Consorzio InterUniver¬sitario Italiano per l’Argentina), finalizzato alla realizzazione di un workshop nell’ambito dell’undicesima edizione delle Jornadas del CUIA en Argentina (aprile 2019).
Ha fatto parte di tre Commissioni ministeriali di riforma:
(a) con Decreto del Ministro della Giustizia 27 luglio 2006 è stato nominato componente della Commissione Ministeriale per la Riforma del codice di procedura penale presieduta dal prof. Giuseppe Riccio;
(b) con Decreto del Ministro della Giustizia 10 giugno 2013 è stato nominato componente della Commissione Ministeriale di studio per proposte di intervento normativo in materia di processo penale presieduta dal dott. Giovanni Canzio.
(c) con Decreto del Ministro della Giustizia 14 dicembre 2017 è stato nominato componente del Gruppo di Lavoro incaricato di dare attuazione alla legge di delegazione europea 2016-2017, in modo da garantire il tempestivo recepimento ed adeguamento dell’ordinamento interno alle prescrizioni europee in materia di protezione dei dati personali, presieduto dalla prof.ssa Giusella Finocchiaro.
È stato convocato in numerose occasioni dalla Commissione Giustizia della Camera dei Deputati per essere interpellato in qualità di esperto.
Ha preso parte, in qualità di relatore o di presidente di sessione, a numerosi convegni scientifici di rilevanza nazionale e internazionale.
Dal 2014 al 2018 è stato Presidente della Biblioteca Norberto Bobbio dell’Università di Torino.
Dal 17 aprile 2018 al 1° settembre 2022 ha esercitato le funzioni di Giudice d’Appello Penale nella Repubblica di San Marino.
Dal 2023 è Direttore del Master Interfacoltà di II Livello in Scienze Forensi (Criminologia-Investigazione-Security-Intelligence), istituito presso il Dipartimento di Studi Giuridici ed Economici, Facoltà di Giurisprudenza, Università di Roma Sapienza.
I temi maggiormente approfonditi nel corso della sua attività di ricerca sono stati il principio del giudice naturale precostituito per legge, il principio di obbligatorietà dell’azione penale, il diritto alla segretezza delle comunicazioni, il giudicato penale e la giurisdizione esecutiva, le dinamiche del ragionamento probatorio.

Francesco Caprioli graduated in Law in 1986 (110/110 cum laude) at the University of Turin, defending a thesis in Criminal Procedure on the removal of criminal proceedings ("Rimessione dei procedimenti penali"). His supervisor was Prof. Gilberto Lozzi; his thesis was awarded the right of publication.
In March 1992 he was appointed University Researcher for the disciplinary grouping No. 10 (hereinafter Scientific Disciplinary Sector IUS16). Until October 31, 1998 he served at the Department of Legal Sciences of the Faculty of Law, University of Turin. From November 1, 1998 to October 31, 2000 he served as Associate Professor of Criminal Procedural Law at the Faculty of Law, University of Cagliari. From November 1, 2000 to October 31, 2004 he served as Full Professor (Straordinario) of Criminal Procedural Law at the same Faculty. From November 1, 2004 to September 30, 2013, he served as Full Professor of Criminal Procedural Law at the Faculty of Law of the University Alma Mater Studiorum of Bologna. From October 1, 2013 to December 20, 2022 he served as Full Professor of Criminal Procedural Law at the Department of Law, University of Turin. Since December 21, 2022, he has served as Full Professor of Criminal Procedural Law at the Department of Legal and Economic Studies, Sapienza University of Rome. He has held the professorships of Criminal Procedural Law (University of Cagliari, Bologna and Turin), Criminal Execution Law (University of Cagliari, Bologna and Turin), Criminal Evidence Law (University of Turin), Elements of Criminal Procedure and Forensic Toxicology (University of Turin).
From 2014 to 2020 he was a member of the Teaching Board of the PhD program "Rights and Institutions" at the Department of Law, University of Turin. Since January 2024, he has been a member of the Teaching Board of the PhD Program in Public Law at the Department of Legal and Economic Studies, Sapienza University of Rome.
He is on the Editorial Board of the journal Cassazione Penale and the Scientific Committee of the journal Archivio della Nuova Procedura Penale.
From February 2011 to May 2013, he was a member of the Scientific Committee of the Superior Council of the Judiciary (“Consiglio Superiore della Magistratura”).
From 2008 to 2014, he was a member of the Board of Directors of the Association among Criminal Trial Scholars (“Associazione tra gli studiosi del processo penale”)
Since 2023 he has been national coordinator of the PRIN (Project of Relevant National Interest) entitled "PRIORITY. Shaping the Prosecution Organisational Model of Criminal Reports," admitted for funding by MUR Decree No. 1409 of September 23, 2023. In 2018, he was among the scientific leaders of the international research project "The People's Jury in the Face of Technological Evidence," funded by CUIA (Italian InterUniversitary Consortium for Argentina), aimed at conducting a workshop as part of the eleventh edition of the Jornadas del CUIA en Argentina (April 2019).
He served on three Ministerial Reform Commissions:
(a) by Decree of the Minister of Justice July 27, 2006, he was appointed as a member of the Ministerial Commission for the Reform of the Code of Criminal Procedure chaired by Prof. Giuseppe Riccio;
(b) by Decree of the Minister of Justice June 10, 2013, he was appointed as a member of the Ministerial Commission for the Study of Proposals for Regulatory Intervention in Criminal Procedure chaired by Dr. Giovanni Canzio.
(c) by Decree of the Minister of Justice December 14, 2017, he was appointed as a member of the Working Group in charge of implementing the 2016-2017 European Delegation Law, so as to ensure the timely transposition and adaptation of the domestic system to the European requirements on the protection of personal data, chaired by Prof. Giusella Finocchiaro.
He was frequently convened by the Justice Commission of the Chamber of Deputies to be addressed as an expert.
He has taken part, as a speaker or session chair, in many scientific conferences of national and international relevance.
From 2014 to 2018, he was president of the Norberto Bobbio Library at the University of Turin.
From April 17, 2018 to September 1, 2022, he served as a Criminal Appellate Judge in the Republic of San Marino.
Since 2023, he has been Director of the Interfaculty Master's Degree Level II in Forensic Science (Criminology-Investigation-Security-Intelligence), established at the Department of Legal and Economic Studies, Faculty of Law, Sapienza University of Rome.
His main research areas are: the principle of the natural judge (judge previously ascertained by law and removal of proceedings); the legality principle (mandatory prosecution); the right of secrecy of communications and law of evidence; the jurisdiction on the sentence enforcement phase ("giurisdizione esecutiva"); the dynamics of evidentiary reasoning.
