Programme:
The limits to free markets within the EU and the balance between individual freedoms and public interests: constitutional and legal framework, in the EU and the national context.
The law and governance of regulation and competition in the EU: fundamental concepts of regulatory strategies, rules and enforcement.
The role,the powers and accountability of independent competition and regulatory agencies, both within the EU and the national context. The complex relationship between competition law and regulation and the advocacy powers of competition agencies.
The function of competition law; an overview of EU and national principles of competition law.
Articles 101 and 102 TFEU: anti-competitive agreements and abuse of dominant position.
MANIMP course only:
The principles and procedures of competition law enforcement: Regulation 1/2003 and public enforcement by the EU Commission.
Textbook:
R. Whish-D. Bailey, Competition Law, Oxford, tenth edition, 2021 (Maninp - 9 CFU Chapters 1-7; EPOS - 6 CFU Chapters 1-5 no paragraphs on the UK system)
Cases and materials:
Slides will be used during the course and will be available on the course's Moodle Platform upon subscription (they are not a substitute for the textbook though!)
Cases will be discussed from time to time in class and made available on the Moodle Platform.

STOP SENDING EMAILS SAYING THAT FOR TECHNICAL REASONS YOU WERE NOT ABLE TO BOOK THE EXAM OR YOU SIMPLY FORGOT TO DO IT AND ASKING ME TO BE ADMITTED. A DEADLINE IS A DEADLINE
The exam will be oral and will last approximately between twenty and thirty minutes. The student will be asked general open-ended questions on the main topics of the program.
In order to pass the exam, the student will have to achieve a minimum mark of 18/30, showing at least a basic knowledge of the main topics. In order to achieve 30/30 con lode, the student will have to show an excellent command of all the topics analyzed during the course, as well as being able to coherently connect them.
Besides, the student will have to show the capability to apply the theoretical notions, by being able to give examples or offer solutions which require the application of acquired notions to concrete examples and cases.
The reference to case-law discussed during the course (for the students who attended it) will be taken into consideration

Ricordo agli studenti che il docente non ha facoltà di aprire discrezionalmente a tutti la partecipazione a questi appelli.
Possono parteciparvi gli studenti laureandi, fuori corso e portatori di DSA e coloro a cui il regolamento di ateneo lo consente. La ragione è che è un appello che si svolge nel pieno dell'attività didattica del semestre non è una normale sessione di esami.
