Focus on Asian Constitutionalism
Asia has generated vibrant constitutional discourses, as indigenous elites sought to fuse Western institutional forms with the grand Asian legal and political traditions.
The aim of this course is to offer to the students an original presentation of comparative knowledge on Constitutional Transitions, focussing on Asia, including both a comparative and a country-based study and a comparison among the systems of the Asian area, as well as an external comparison, that is to say with respect to the public law system belonging to the western legal tradition.
The course will focus on some constitutional challenges in the historical context of constitutional transitions and state-building, through a substantive comparisons or identifying commonalities and differences in constitutional responses to similar problems and issues.
Overall aim of the Course
In early 21st Century, Asian countries have developed increasingly vibrant practices of constitutional law and the overall intent of the course is that of offering an up-to-date and in-depth comprehension of recent institutional transformation occurring in the most important Countries in Asia – as India, China and Hong Kong, Japan, Singapore, Malaysia - and appreciate the original Asian contributions to the ideologies of constitutionalism.
About the Methods
The description of the process and the substance of Constitution making and further constitutional development in the most important Countries integrates knowledge from other disciplines, particularly historical studies and political sciences to better understand the contexts of each case – including the legacies of earlier colonial or imperial periods, the social composition, the cultural divisions, the religious issues and ideological commitments in framing constitutional debates and constitutional interpretation.

Modalità di svolgimento dell'esame
L’esame consiste in un esame orale. Agli studenti frequentanti è riservata la possibilità di sostituire una parte dell’esame con due esoneri scritti che si terranno ad aprile e a maggio. Le date verranno concordate all'inizio del corso.

GLOBAL CONSTITUTIONALISM: ASIA - PACIFIC PERSPECTIVES

Asia has generated vibrant constitutional discourses, as indigenous elites sought to fuse Western institutional forms with the grand Asian legal and political traditions.
This course aims at offering to the students an original presentation of comparative knowledge on Constitutional Transitions, focussing on Asia, including both a comparative and a country-based study.
This course aims to explore some of the key concepts of constitutionalism - democracy, pluralism, secularism- leaving aside the traditional perspective developed within Western constitutionalism, in order to delve into the different answers offered within some Asian systems (India, Singapore, Japan, China and Hong Kong). The aim is to delve into new emerging models and reflect on their potential contribution to the understanding of our increasingly plural societies in the face of the challenges of globalization.
