Course program
The course progressively guides students from foundational knowledge to a critical appraisal of administrative practice. It begins with an examination of the constitutional principles governing public administration, and with the identification of the main sources of administrative law, so as to recognize normative hierarchies and scopes of application; it then turns to organizational design, comparing decentralization and subsidiarity, and assessing how these choices affect the allocation of functions. Within this framework, the organization of the National Health Service and the Regional Health Services will be analyzed, with specific attention to the distribution of administrative competences across levels of government, to loyal cooperation, and to coordination mechanisms.
Subsequently, students will apply the principles of transparency and personal data protection in real public-sector contexts, distinguishing duties of disclosure, limits, and safeguards; they will be able to examine and manage requests for access to administrative documents, to argue the grounds for granting or denying access, and to draft coherent acts. The course then reconstructs the administrative procedure in its phases, enabling the design and evaluation of decision-making processes that comply with legality, efficiency, and participation; it concludes with an in-depth study of administrative liability, with particular regard to financial loss to the public purse, and of the role of the Court of Audit in oversight and adjudication, so as to interpret cases, justify decisions, and propose operational solutions aligned with the public interest.
