Course program
The module introduces the notion, function, and evolution of labour law in Italy, clarifying the architecture of sources (Constitution, statutes, collective bargaining agreements, practice, and case law) and their hierarchy. It then examines the distinction between subordinate employment and other work arrangements, outlining qualifying indicators (employer control, organisational integration, continuity) and hybrid forms, with attention to risks of misclassification. The core elements of the employment relationship are addressed: formation of the contract, duties and ius variandi, managerial and disciplinary powers, working time, pay, and health and safety, followed by termination modes (resignation, dismissal, mutual consent) and related protection regimes. The interplay between collective agreements and individual contracts is analysed in terms of effectiveness, scope of application, most-favourable-term clauses, margins of individual autonomy, conflicts between sources, and techniques for resolving them. A focused section covers public employment, comparing the “privatised” regime with private-sector rules on recruitment, career progression, liability, and collective bargaining. Finally, the overview of trade union law addresses trade union freedoms and activities in the workplace, representation and representativeness, multi-level collective bargaining, the right to strike, and rules for essential public services, providing tools to interpret and manage collective dynamics within organisations.
