PUBLIC LAW OF CULTURAL HERITAGE
Course objectives
The course offers a theoretical and legal framework of cultural heritage and explores the main issues and problems of the relationship between “protection” and “enhancement.” Subject of specific discussion will be: the definition of the concepts of “good” and “cultural” “heritage”; the analysis of the normative evolution of reference, from the principals of protection provided by the pre-unitary Italian states up to the approval of Article 9 of the Constitution, until the entry into force of the Code of Cultural Heritage and its most recent amendments and additions. It will then examine the current institutional arrangement of cultural heritage, analyzing the concrete development of enhancement and management policies also in the light of the main conceptions of enhancement prerogatives, looking at the main reference institutions. Finally, a series of case studies will be examined in order to observe the development of administrative jurisprudence on cultural heritage protection.
