Course program
The course will provide elements and tools for studying gender issues from a constitutional perspective.
The main stages in overcoming inequalities in the constitutional system will be examined, starting with the contribution of women to the Constituent Assembly, the formulation and structure of the principle of formal and substantive equality, reasonableness, the principle of equality with reference to gender, and the role of women in the family, at work and in political representation. The path taken on these issues in ordinary legislation and constitutional jurisprudence will be examined. The culture of difference applied to gender issues and the link between these and the principle of equality will be discussed.
In parallel with the lectures by Prof. Amorosi, who will provide a brief constitutional overview and then focus her lectures on the principles and institutions concerning equality, equal opportunities, rights, representation and gender, Prof. Pacella will conduct a series of in-depth studies, mainly based on case studies. In particular, Prof. Pacella's lectures will be dedicated to providing an overview of the issues raised by the courts and legislators in the recognition of fundamental rights and to examining individual cases of recognition, such as those related to sexuality (e.g. abortion and prostitution).
Particular attention will be paid to the issue of gender-based violence and, specifically, to the protection provided by the legal system with regard to the most serious violations of women's fundamental rights.
