SOCIAL SECURITY LAW

Course objectives

The course aims to provide students with the knowledge of national welfare system, in his legal aspects, also through the comparison with other European social security systems and the study of the European coordination of national social security systems. More specifically, the course is designed to provide with a solid preparation in the field of social security, which allows them to be critically oriented towards the different aspects of welfare state, with reference to both national and European legislation. Particular attention will be devoted to the: diachronic reconstruction of pensions legislation; regulatory framework of "social safety nets"; actions to combat poverty and social exclusion; growing development of the role of private parties in management of welfare policies. At the end of the course, students will gain critical awareness of the functioning of the welfare system, especially in the current socio-economic context, characterized by significant problems of economic sustainability. Students will also acquire a correct legal language and a specialized terminology to develop communication skills, also through classroom discussion of concrete cases and active participation in group exercises.

Course program
The European models of social security system: historical evolution. The national social security system. Sources. The relation between public and private role. Financing and events. The national pension system. The reforms of the ‘90 and after: in particulary, the Reform of 2011. Complementary pension. Protection against unemployment. Accidents at work and occupational diseases. Family protection. Social protection for non standard workers. Employment mobility: the principles of reunion and aggregation. The social security european law. The role of the Court of justice.

Cinelli M., Giubboni S., Lineamenti di diritto della previdenza sociale, Cedam, last edition. Social security law is a constantly evolving subject. Students are advised to wait until classes begin to purchase the Manual.
Frequency
Attendance is not mandatory, but strongly recommended
Exam mode
The course consists of frontal lessons and practical-theoretical cutting exercises with active involvement of students. During practical exercises, students will be guided in the analysis and discussion of case law.
Lesson mode
Classes will take place in attendance on Monday, Tuesday and Thursday. During the lessons the teacher will use slides and other teaching materials (norms; sentences; other in-depth documents). The course is mainly organized with traditional frontal lessons; case studies analyses, and discussions on specific jurisprudential topics are also provided. Those interested in attending classes are required to register on Classroom; the code will be made available a few days before the start of classes, via the teacher's web page.
