PUBLIC LAW, INFORMATION AND COMMUNICATION

Course objectives

1) This module aims at providing students with those fundamentals which are necessary to understand the structure and functioning of the Italian state system, its relationship with the international community and in particular with the European Union, the rights and liberty guaranteed to citizens and the regulation of the media system as far as journalism, broadcasting system and communication tecnologies are concerned. This knowledge is essential for the education of future professionals in the field of information and communication. 2) After attending the module and passing the final exam students will be able to fully understand the organization and operation of the Italian State, its relationship with the international/EU legal order and the fundamental rules of media system. Course program
Part I, public law: the legal system, the State, the Constitution, the international system, the European Union system, the sources of law, the protection of the person and fundamental rights, the list of rights, the forms of government, the principle of popular sovereignty, the Parliament, the President of the Republic, the government of the Republic, the judicial system, constitutional justice, the republican system and its historical evolution. Part II, information law: freedom of expression and its limits, especially considering the evolution of digital technologies, the regulation of the press and journalism.
Prerequisites
None. However, students should regularly read newspapers. Students willing to join this course MUST register on the Moodle platform (https://elearning.uniroma1.it/), in order to receive information about lessons, tests, exams etc.

1) A. Barbera, C. Fusaro and C. Caruso, Corso di diritto pubblico, Bologna, il Mulino,13th edition 2024 or more recent ones (excluding chapters XIV and XV). 2) M. R. Allegri, Informazione e comunicazione nell'ordinamento giuridico italiano, Vecchi e nuovi media fra diritto e progresso tecnologico, terza edizione, Torino, Giappichelli, 2023: only preface, introduction, chap. 1, chap. 2, chap. 3, par. 7 of chap. 4 (what AGCom is and what it does). It is also necessary to know the Italian Constitution well. The book "La Costituzione esplicata" (edizione Simone) is recommended.
Frequency
Regular attendance of the lessons is recommended, in order to achieve a better outcome of the final exam. However, attendance will not be counted.
Exam mode
Optional written test (open questions) concerning a part of the programme, whose result will be considered for assessing the definitive mark. The written test is reserved to attending students only. Oral examination concerning the remaining part of the programme (or the entire programme for those who haven't taken or passed the written test). Sufficiency will be achieved by those demonstrating a basic knowledge of the topics covered by the course and adequate expressive abilities. The highest marks will be awarded to those demonstrating an excellent command of the topics covered by the course, as well as excellent expressive abilities.
Lesson mode
Frontal teaching with the possible use of slides or other materials to be shown in the classroom. Discussion and debate with students are always encouraged and appreciated.

Exam mode
The final assessment will be carried out with an oral exam structured to deepen the knowledge of both study texts: the public law manual and the information and communication law text.
Lesson mode
The course follows a historical-social and comparative approach, structured to share a specific and common foundation in the fundamentals of public law, information, and communication, starting from the republican system and placing it within the European and global context. Lectures will be held, with student contributions planned and scheduled. Meetings with scholars and professionals in the information and communication sector will be scheduled. For attending students, meetings and seminars will be scheduled on specific topics related to the program, with the opportunity to delve deeper into specific sections of the program, to be presented in the oral exam.
